THE TOYOTA ‘MAKE THINGS BETTER’ CONTEST RULES AND REGULATIONS

Enter the ‘Toyota Make Things Better’ Contest for your chance to win $10,000 CAD

Entrants must be residents of Canada and have reached the age of majority in the province or territory in which they reside at the time of contest entry. This contest is not open to the employees and representatives of a participating trade show, Toyota Canada Inc., their agents, dealers, parent, affiliated or related companies, partners, subsidiaries, divisions or their advertising and promotional agencies, or the suppliers of services, materials and prizes used in this contest as well as any person living in the same household as such persons.

By entering this contest, the winner is deemed to have authorized the use of their name(s) and/or photograph(s) and/or image(s) and/or voice(s) by the contest organizers, if the contest organizers so desire, for advertising, promotional purposes and/or for general news or entertainment purposes at no compensation to the winner.

The contest starts at approximately 9am EST on January 13, 2012 and ends 9pm EST December 31, 2012, (“Contest Closing Date”). There will be a total of one (1) Grand Prize to be awarded.

HOW TO ENTER:

NO PURCHASE IS NECESSARY. To enter the contest, complete a ballot during trade show business hours. Ballots are found in four different ways (1) paper ballots; (2) electronic ballots at Toyota electronic kiosks at trade shows; (3) online ballot at www.contest.toyota.ca (4) through the mobile site accessed through the contest Quick Response (QR) codes available at the Toyota display at trade shows. By submitting a contest entry as listed above, you will receive one (1) contest entry into the Grand Prize draw. There is a limit of one (1) entry per person irrespective of method of entry. All entries must include your name, address, 10 digit daytime telephone number, and e-mail address. All entries must be received by the Contest Closing Date to be eligible. If it is discovered that you attempted to enter more than once, all your entries will be void.

PRIZE:

Grand Prize: There will be one (1) Grand Prize of $10,000 CAD.

CONTEST DRAW DATE:

The contest winner will be randomly selected by an independent contest judging organization on January 8th, 2013, from among all eligible entries received on or before the Contest Closing Date. Odds of being selected as a prize winner will be dependent on the total number of eligible entries received during the contest period. Contest organizers will attempt to contact the selected entrant after the draw by telephone or email within seven (7) business days following the draw. In order to be declared the winner, contest winner must first answer, unassisted, a time-limited mathematical skill testing question. In the event that a selected entrant is disqualified from eligibility, does not correctly answer the mathematical skill testing question within the time limit, cannot be contacted by contest organizers within seven (7) business days following the draw, the contest organizers shall have the right to disqualify the selected entrant and redraw another entrant as an eligible prize winner and the contest organizers shall be fully and completely released and discharged from any liability or responsibility of any nature and kind to any previously selected entrant in this regard. By entering this contest, the entrants automatically agree to accept and abide by these rules.

GENERAL REGULATIONS:

Entries are subject to verification by the contest organizers. Entries that are illegible, mutilated, changed or altered in any way shall be deemed void and rejected. The judges’ decisions shall be final and without appeal. Facsimiles or photocopies of entry forms will not be accepted. All entries are the property of Toyota Canada Inc. and none will be returned. Toyota Canada Inc. assumes no responsibility for lost, delayed, destroyed or misdirected entries. Toyota Canada Inc. will not be responsible for late, lost, illegible, falsified, incomplete or destroyed entries and all such entries are void. Toyota Canada Inc. does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. If, for any reason, the draw is not capable of running as planned or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Toyota Canada Inc. reserves the right, subject to approval of the Régie des alcools, des courses et des jeux (the “Régie”), to cancel, terminate, modify or suspend the draw, including cancelling any method of entry, and selecting a winner from previously received eligible entries. The Contest Sponsors reserve their right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Contest Sponsors in their sole discretion, further reserve their right to terminate the Contest and conduct the drawing from all entries previously received during the Contest Period. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsors reserve their right to seek remedies and damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable. The prize must be accepted in the form in which it is awarded. It may not be transferred or traded. The contest organizers reserve the right to award a prize of equivalent or higher value. The winner must pay for all charges or costs other than those specifically mentioned as being included in the prize. By entering, entrants acknowledge that they have read these official rules and agree to abide by the official rules of the contest and decisions of Toyota Canada Inc. and the independent contest judging organization, which are final. The winner shall agree to waive all liability against the organizers and sponsors of this contest, as well as against their advertising and promotional agencies, for any damage or prejudice arising out of or resulting from the awarding and use of the prize or this contest. The winner must sign a legal declaration and waiver of liability to this effect before claiming their prize. If a potential winner fails to sign and return the waiver form within 14 days of its receipt, Toyota Canada Inc. reserves the right to void that entry and select another eligible entrant. This contest is subject to all applicable federal, provincial and municipal laws and regulations. No correspondence will be entered into except with entrants requesting Rules by mail or requesting names of the Prize winner (for which a self-addressed, postage paid envelope must be included).

PRIVACY POLICY:

By providing personally identifiable information, such as your name, contact information, and if applicable, your purchase preferences, you consent to the collection of this personally identifiable information by Toyota Canada Inc. and its authorized dealers for the purpose of administering this contest, and, unless you indicate otherwise, you agree that we may also use and share with our authorized dealers, any or all of the personally identifiable information we have collected for the purposes improving products and services and better understanding your automotive needs and including you in advertising or marketing campaigns to offer you their products and/or services. If you would prefer that we do not use your personally identifiable information for such advertising or marketing campaigns, please call Toyota Canada Inc. at 1-888-Toyota-8. We retain personally identifiable information on our databases in Toronto, Ontario for the period of time required to administer this contest and for a period of time thereafter for marketing purposes. You may review and update or correct the personally identifiable information that you provide on this contest ballot or change or withdraw your consent by contacting us at 1-888-Toyota-8.

RESIDENTS OF QUEBEC:

Residents of Quebec may submit any litigation respecting the conduct or organization of a publicity contest to the Régie des alcools, des courses, et des jeux. For residents of Quebec, any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
